1. Who we are
These Terms & Conditions govern your use of the Phoney Number service at phoneynumber.com.
By creating an account and accepting these terms at checkout, you agree to be bound by them. If you do not agree, do not use the service.
2. The service
Phoney Number provides virtual phone numbers with call forwarding, IVR menu, and voicemail-to-email functionality. The service is provided on a month-to-month subscription basis with no minimum term.
Features available depend on the plan tier you select (Basic, Connect, or Professional). Feature descriptions are available at phoneynumber.com/pricing.
3. Account registration and acceptance of terms
When you sign up for Phoney Number, you are required to accept these Terms & Conditions at the point of checkout. Your acceptance is:
- Recorded with a timestamp against your account
- A binding agreement between you and Phoney Number
- Required before any phone number is provisioned to your account
You must provide a valid email address and payment method. You are responsible for keeping both current at all times.
4. Payment and billing
Subscriptions are billed monthly in advance. Payments are processed by Stripe. The price shown at checkout is the price you pay — there are no hidden fees.
Your responsibility: It is your sole responsibility to keep your payment method current and to ensure payments are made on time. Phoney Number is not responsible for service interruptions caused by your failure to maintain valid payment details.
Prices are displayed in USD, GBP, and EUR. All charges are processed in USD unless otherwise specified at checkout.
5. No refunds
All payments are non-refundable. Once a phone number has been provisioned to your account, no refund will be issued for the current billing period, regardless of usage.
If you cancel your subscription, you will retain access to the service until the end of the current billing period, followed by the 7-day grace period described in Section 6.
Exceptions may be made at Phoney Number's sole discretion in cases of demonstrable technical failure on our part.
6. Payment failure and number release
If a payment fails, the following graduated process applies:
- Payment fails (day 0): Call forwarding and outbound calling are paused immediately. Voicemail to email continues to function. You will receive an email notification.
- Retry period: Stripe will automatically retry your payment according to its standard schedule. If payment succeeds on any retry, your service is fully restored automatically.
- Retries exhausted: If all retries fail and your subscription is cancelled or marked unpaid by Stripe, voicemail also stops. Your number enters a 7-day grace period.
- Grace period (7 days): Your number is held for 7 days with no active service. You will receive email warnings during this period. If payment is not resolved within 7 days, your number is permanently released.
- Number release: Once released, your number is returned to the pool and cannot be recovered. Phoney Number accepts no liability for the loss of a number due to non-payment.
Important: Number release is permanent and non-recoverable. Once your number has been released, it cannot be reassigned to you. It is your responsibility to resolve payment issues before the grace period expires.
7. Voluntary cancellation
You may cancel your subscription at any time through the billing portal in your dashboard. Upon cancellation:
- You retain full service until the end of the current billing period you have paid for
- Call forwarding is not immediately paused on voluntary cancellation (unlike payment failure)
- After the billing period ends, your number enters the 7-day grace period before release
8. Acceptable use
You agree not to use Phoney Number for:
- Fraud, impersonation, or deception
- Harassment, threats, or abusive communications
- Spam, unsolicited marketing, or robocalling
- Any illegal activity under applicable law
- Impersonating banks, government bodies, or other regulated entities
- Any activity that violates Twilio's Acceptable Use Policy
Phoney Number reserves the right to terminate your account immediately and without refund if you breach these acceptable use provisions.
9. SMS and verification codes
Phoney Number provides virtual phone numbers that may be used to receive SMS messages. However, we do not guarantee that your number will be accepted for verification purposes by any specific third-party service (including but not limited to WhatsApp, Google, or social media platforms). Some platforms actively block virtual numbers. This is outside our control and is not grounds for a refund.
10. Service availability
We aim to provide a reliable service but do not guarantee 100% uptime. Phoney Number is provided "as is" and Phoney Number accepts no liability for service interruptions caused by third-party providers including Twilio, Stripe, Amazon Web Services, or your internet service provider.
11. Data and privacy
Your account data, call logs, and voicemail transcriptions are stored securely and are not sold to third parties. Voicemail audio and transcriptions are retained for 90 days and then deleted automatically.
By using the service, you consent to the processing of your data as described in our Privacy Policy.
12. Disputes and chargebacks
If you believe a charge has been made in error, please contact us at contact us before initiating a chargeback with your bank. We will respond within 2 business days.
Initiating a chargeback without first contacting us may result in immediate account suspension. Your timestamped acceptance of these terms, together with your usage records, will be submitted as evidence in any payment dispute.
13. Limitation of liability
To the maximum extent permitted by law, Phoney Number's total liability to you for any claim arising from your use of Phoney Number shall not exceed the amount you paid in the 30 days preceding the claim.
Phoney Number is not liable for any indirect, consequential, or special damages, including loss of business, loss of revenue, or loss of data.
14. Changes to these terms
Phoney Number may update these Terms & Conditions from time to time. You will be notified by email of any material changes. Continued use of the service after notification constitutes acceptance of the updated terms.
15. Governing law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
